CHRISTMAS TREE PICK UP
Mr. Kassay stated it is that time of year again for
recycling Christmas trees. The Town of
Mr. Kassay made a motion to authorize the Town Clerk, Antoinette Kopeck to do a Press Release regarding Christmas tree recycling pick-up.

CONFERENCE REQUEST FORM
Mrs. Nacerino stated at the last meeting I distributed a Conference Request Form for adoption for this Town Board. This would be a clean form and everyone requesting to go to a conference would fill out this form, which would make it easier than writing an individual memo.
PATTERSON TOWN BOARD
Mrs. Nacerino made a motion to table this because the Town Comptroller, Patricia Brooks had one revision and I would like to get that revision from her before the final adoption.

Mr. O’Connor stated if you are going to revise it could you please leave off the abbreviations on the form because I don’t know what they are talking about.
Mrs. Nacerino stated as we go into 2009 with the economic
climb the way it is we should be very cognizant that conferences should only be
top priority. We shouldn’t just approve
anything that comes before us. It should
be something that is very critical to the job performance for that year. In

ASSESSOR REQUEST – TRAINING
Mrs. Nacerino stated the Town Board received a memo from the
Town Assessor, Christopher Boryk to request that Amanda Tompkins attend the New
York State Office of Real Property Services course; Fundamentals of Assessment
Administration. This six day classroom
session training is scheduled in
Mrs. Nacerino stated this memo in this context does not address the necessary information that this Board would need to approve any conference therefore, I have asked Mr. Boryk to follow up with another memo that stipulates the hotel at six days at $111.00 per day which is $666.00. We are exempt from the tax, meals at $50.00 per day for six days would be $300.00 and travel which is approximately 425 miles at $0.585 per mile for a total of $249.00. The total conference would be $1,308.00. This is something that is fundamental to Amanda to work efficiently in the Assessor’s office.
Mrs. Nacerino made a motion to approve this conference not to exceed $1,308.00.

Mrs. Nacerino made a motion
to authorize the Town Clerk to advertise the Public Hearing for the Amendment
of Chapter 72 of the Patterson Town Code for the Chronic Public Nuisance Law on

RFP – ENGINEER
Mrs. Nacerino made a motion
to authorize the Town Clerk to advertise the bid opening for the RFP – Engineer

Mr. Griffin stated I will abstain because I haven’t had a chance to review the RFP and comment on it and I am not sure what is in there or what we are asking for.
Mrs. Nacerino stated Mrs. Kopeck and I have discussed it and one of the reasons why we thought it would be best for January 20, 2009 was that it would give the Board the opportunity to review it before the January 28, 2009 Town Board meeting.
Mr. Capasso stated was it reviewed by the Attorney.
Mr. Griffin stated I don’t know who has had a chance to look at it. If you want to move forward on this I don’t take issue with it.
Mrs. Nacerino stated we should have ample time.
Ms. Edie Keasbey stated who wrote the bid.
Mr. Griffin stated the RFP was written by the Town Planner.
Ms. Keasbey stated when can the public see it. The engineers that we had for a long time really had no environmental training at all.
Mr. Griffin stated I am not sure what is in the RFP, I haven’t looked at it. We will see if
Mr. Riebold can put it up on the website.
Mr. O’Connor stated it might be a little premature moving ahead with it.
Mr. Kassay stated I looked at it and I would like the Town Attorney to look over the document.
Mr. Kassay stated do you want to move the bid opening to January 27, 2009 and have the Public Hearing at the February 11, 2009 Town Board meeting.
Mrs. Nacerino stated I will rescind the above motion.

DIRECTOR OF CODES ENFORCEMENT
Mr. O’Connor stated I would like to table the Director of Codes Enforcement until Executive Session.
CHANGES TO PERSONNEL POLICY
Mr. O’Connor stated I have three resolutions for the changes to the Personnel Policy. We found out that you have to give sixty days notice according to the State when changes are made, so it is important that we do this in a timely fashion.
Mr. O’Connor introduced the following Resolution Changes in Personnel Policy Regarding Medical Insurance for
Retirees.
Seconded by Mr. Kassay for the purposes of discussion. Could you please refresh my memory on how we came up with that percentage. Did we do a comparison on what the actual figures would be.
Mr. O’Connor stated I don’t recall any comparison of what the figures would be. I believe we discussed the numbers.
Mr. Kassay stated I would like to see the figures in it so the employees will have a better idea of what the impact will be on them.
Mr. Griffin stated this is a moving target to a degree. This is a defined contribution plan and it will be based on the current premiums for the medical insurance at the time of retirement. I can give you the figures for 2009, but I couldn’t project for the years to come.
Mr. Kassay stated would it be unreasonable to ask to have it in there so employees can see what they are up against.
Mrs. Nacerino stated this resolution just affects retirees. I don’t know if it would affect anyone in 2009.
Mr. Griffin stated future retirees.
Mr. Kassay stated are we doing away with the in-lieu for retirees entirely or are we going to do a percentage. I’m confused about that.
Mr. Griffin stated anyone who retires and has benefits in
another pension plan is not eligible for benefits through the NYSHIP plan. If you retired from
Mrs. Nacerino stated what about those who have a spouse that has the medical plan. That is sort of a loop hole because if you retire and the employee is holding the insurance that is one thing, but if a spouse holds the insurance then that is a whole different scenario. Have we projected to include if a retiree can then opt to take the spouses insurance or vice versa.
Mr. Kassay stated that is a valid point. I’m a little confused on all three of these but that might only be me.
Mr. Griffin stated the first resolution regarding retirees is a defined benefits plan and what it does is rescinds the resolution that was passed in 2006 that gave in-lieu of in retirement. Based on conversations with NYSHIP most of the people that will be

affected by that are the ones who weren’t eligible in the
plan in the first place. For example, if
I retired from the State Police and I have my medical insurance through the
State PBA and I work for the Town of
Mrs. Nacerino stated but you could flip your plan from your
spouses to yourself. If the Town of
Mr. Kassay stated the resolution that the Town Board adopted
on
Mrs. Nacerino stated I never had an objection to lowering the in-lieu of. My only concern is that we have not adopted a comprehensive plan, which addresses all the concerns and all the loop holes that might occur. Until we do something that is comprehensive, and we will meet with Bruce Major to develop this, we really have not taken into consideration what may or may not occur and if in fact it is a cost effective measure.
Mr. Griffin stated the recision of R-0906-03 basically is the in-lieu of in retirement that was passed in 2006.
Mr. John Taylor stated is there going to be any differentiation between an employee of the Town or a member of a Collective Bargaining Unit and an Elected Official. If an Elected Official gets voted out of office is that person considered retired or no longer wanted by the public. In lieu-of payments for either retirees of any sort whether they are Elected Officials who have been voted out of office or not running anymore, I think is just asking us taxpayers to pay a little too much money for no particular reason and no valid reason. I spent thirty years in the Civil Service and I was a union representative and when I retired my sick leave…..Elected Officials can’t accumulate but employees can and I have no problem with employees receiving these benefits aside from the in-lieu of if they leave service, but I accumulated sick time and that was calculated and I could purchase my health insurance with that sick time and the rest I had to pay out of my pocket. If I declined that insurance, which I did, I was not given any money. My sick time was in a bank and if I ever needed it, it was there or I could turn it back to the State for them to use. In-lieu of payments for people who don’t want health insurance after they leave public service is an absurd idea.
Mrs. Nacerino stated we agree with you and that is why it is on the table.
Mr. Griffin stated this has nothing to do with union
employees. Their benefits are covered by
a contract. This is for Town Hall,

Mrs. Nacerino stated this should have been looked at ten years ago. Hopefully we will remedy this.
Mr. Kassay stated don’t we have to have a resolution to
rescind the resolution of
Mr. Carl Lodes, Town Attorney stated your resolution now is going forward. This would still cover those people that have retired and you wouldn’t rescind that.
Mr. Griffin stated the resolution of 2006 was never incorporated into a local law. Mr. Curtiss reviewed these and was fine with all of these resolutions.
After much discussion amongst the Town Board regarding the above topic Mr. O’Connor tabled the resolution.
Mr. O’Connor made a motion to table the first resolution Changes to Personnel Policy Regarding Medical Insurance for Retirees.

Mr. O’Connor introduced the following Resolution Changes in Personnel Policy Regarding Medical Insurance Premium Payments:

WHEREAS, the Town of Patterson is seeking to reduce the cost of health insurance premiums paid by the Town on behalf of the eligible full-time employees and Elected Officials; and
WHEREAS, the Town of
Premium Payment – The Town and the full-time employee or Elected Official shall both contribute to the cost of the premium for medical insurance coverage as follows: The full-time employee or Elected Official shall be responsible to pay annually the amount of Three Hundred Fifty Dollars ($350.00) or four percent (4%), whichever is greater, toward the cost of the premium for individual coverage and Seven Hundred Fifty Dollars ($750.00) or four percent (4%), whichever is greater, toward the cost of the premium for family coverage. The amount of contribution to be paid by the employee or Elected Official shall be paid in equal installments and shall be deducted directly from the employee’s or elected official’s paycheck. Town Council members who are only eligible for individual medical coverage shall contribute annually towards the cost of the premium for the individual medical coverage in the amount of Three Hundred Fifty Dollars ($350.00) or four percent (4%) whichever is greater. Town Board members, who elect to receive family medical coverage, shall contribute annually twenty-five percent (25%) of the difference between the individual coverage and the family coverage plus the amount of Three Hundred Fifty Dollars ($350.00). The amount of contribution to be paid by the employee, Elected Official or Town Council member shall be paid in equal installments and shall be deducted directly from the employee’s, elected official’s or Town Council member’s paycheck.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town
of
PATTERSON TOWN BOARD

BE IT FURTHER RESOLVED, that the Town Board of the Town of
Mr. Capasso stated how is that deducted.
Mr. Griffin stated on a bi-weekly basis from their paycheck.
Mr. Kassay stated do you feel that the percentage that is listed here is ample or do you
think it should be higher or do you want to address this each year.
Mr. O’Connor stated this is not a dramatic hit on people. The days of paying for insurance one hundred percent are over. We have been able to avoid layoffs in Patterson.
Mrs. Nacerino stated it is still very conservative but it is a step in the right direction. The employees did not realize that this would occur in 2009 except for a few weeks ago. Their raises are less than four percent.
Mr. O’Connor stated this is only four percent of the premium.
Mrs. Nacerino stated but it is still a hit for them.
Mr. Griffin stated keep in mind the medical insurance premium went up eight percent so they are still ahead of the game. A family plan is somewhere around $15,000.00 and an individual plan is around $9,000.00.
Mrs. Nacerino stated we are still only addressing those who do not take the medical insurance as an offset to the medical expenses. The eight percent affects those who do take the medical expenses. These are not the people that are impacting our medical expenses.
Mr. Kassay stated this is only for those who take the medical insurance.

Mr. O’Connor introduced the following Resolution for Changes in Personnel Policy Regarding Medical Insurance
Buy-out:

WHEREAS, the Town of Patterson wishes to limit the buy-out amount for those employees who wish to receive a cash buy-out in lieu of receiving medical insurance benefits through the Town; and
WHEREAS, the Town of Patterson wishes to amend the “Amount of Buy-Out” provision of the “Medical Insurance Buy-Out” section of the Town Personnel Policy to reflect the following:
Amount of Buy-Out – Full-time employees who are eligible for the medical insurance buy-out will receive a payment of Three Thousand Dollars ($3,000.00) annually in lieu of accepting individual coverage or Six Thousand Dollars ($6,000.00) annually in lieu of accepting family coverage, depending upon eligibility. Town Council members being eligible for individual coverage only, shall receive a payment of Three Thousand Dollars ($3,000.00) annually in lieu of accepting medical insurance.
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of

BE IT FURTHER RESOLVED, that the Town Board of the Town of
Mr. Kassay stated I wholeheartedly agree with you that the full time employees should be capped at $6,000.00 and the Elected Officials at $3,000.00 for in-lieu of. The only thing I question is that it doesn’t leave any other option for the ones who take the in-lieu of. If the Town is willing to pay a percentage of medical insurance, to be fare to the employees who take the in-lieu of, is there anyway to make a comparison. If you are going to give the employees who take full medical and they are paying thirty five percent….
Mrs. Maryann O’Connor stated you are going against what you said you were going to do before. We sat for two very long meetings and went through all of this and you promised that you were going to act a certain way. Go through with it now and stop the questioning. If Mrs. Nacerino wants to work on a full program of correcting all the personnel problems, I’m all for it, but after you say yes to these proposals. You said yes in front of four hundred people, now say yes in front of this small group.
Mrs. Nacerino stated what Mr. Major and Mr. O’Connor and I are going to work on is to see if we are getting the best possible medical insurance for the Town. NYSHIP might not be the best medical plan around.
Mr. Kassay stated what I am trying to do is be fair. Everyone should be paying the same percentage no matter what type of insurance plan they take.
Mr. Griffin stated right now if you work for the Town for ten years the Town pays for medical for me and my spouse until death. We are trying to change that. We looked at what was legally allowed to be required of the individual.

Mr. Kassay stated if a person elects to take the in-lieu of and they don’t want to take the medical isn’t that a savings for the Town.
Mr. Griffin stated yes.
Mr. Kassay stated shouldn’t the person who takes in-lieu of have the option to switch over to full medical upon retirement. That doesn’t say that in this resolution.
Mr. Griffin stated no, it doesn’t.
Mr. Kassay stated shouldn’t it say that.
Mr. Griffin stated you can switch anytime you like. The only thing is you have to be on it when you retire or you are not eligible for any benefits afterwards.
Mr. Kassay stated under the old policy if you were on in-lieu of you would have had the choice every November to switch over to full medical.
Mr. Griffin stated I thought you could switch any time you like.
Mr. Kassay stated I thought it was November.
Ms. Sue Brown, Confidential Secretary stated if you have involuntary loss of coverage you can join NYSHIP at anytime. If you chose to cancel your benefits then you have a waiting period.
Mr. Kassay stated and that waiting period would be yearly.
Ms. Brown stated I believe it is three months.
Mr. Capasso stated if an employee is hired on January 1, do they get the benefits the first day or is there a waiting period.
Mr. Griffin stated in the 1992 resolution it is three months.
Mr. Capasso stated we have not been doing that.
Mr. Griffin stated that is true we have not been doing that. We have really wandered off track here.
Mr. Kassay stated my only question is do we give consideration to retirees to have a choice of taking the medical.
Mr. Griffin stated we tabled the resolution regarding retirees so we are no longer talking about retirees. We are talking about the two resolutions that Mr. O’Connor would like to move on. The one that passed is the contribution for current employees. The one he is proposing now is change the in-lieu of for current employees.
Mr. O’Connor stated the purpose of in-lieu of is to encourage employees not to take the medical insurance. We have to offer enough to make it attractive for employees to take the in-lieu of.
Mrs. Nacerino stated again out of all the Towns in
Ms. Keasbey stated you are all very lucky to have medical benefits.

Mrs. Nacerino stated I agree but we are speaking fiscally only. I think this is excessive as well. How long have Elected Officials been taking in-lieu of.
Mr. Kassay stated since 1992.
Mr. O’Connor stated $6,000.00 seemed like a reasonable amount to set the in-lieu at.
Mrs. Nacerino stated it is and this isn’t set in stone. We could revisit this from year to year. I think we need to move forward with this tonight. I think Mr. Kassay has very valid concerns, because we don’t want all the retirees to go on the medical benefits.
Mr. Steve Mandras stated why do part-time employees get
full-time benefits in the Town of
Mr. O’Connor stated what part-time employees are you talking about.
Mrs. Nacerino stated they don’t.
Mr. Capasso stated only us, but we are elected.
Mr. Mandras stated so the four of you that are part-time get full-time benefits.
Mr. O’Connor stated technically Elected Officials are not defined as part-time.
Mrs. Nacerino stated and literally the Elected Officials are not part-time.
Mr. Mandras stated there are no other employees that are collecting that.
Mr. Kassay stated no absolutely not.
Mrs. Nacerino stated that goes for the County and every
other Town in
Mr. O’Connor stated I don’t punch a clock but if I added up the hours…….

Mrs. Nacerino stated I have one request. Can the Supervisor’s office put out a memo to the employee’s advising them of these changes, because a lot of times they feel misinformed.
Mr. O’Connor stated yes we will. We didn’t want to send it out ahead of time because I didn’t know what was going to happen.
Mr. Griffin stated and this payment will not take effect until March.
PERFORMANCE BOND – CODE CHANGE
Mr. O’Connor stated there is a site plan bond for Tractor Supply in the amount of $453,000.00 and an inspection fee in the amount of $22,000.00 and change, which is a little bit excessive and not meeting the requirements. We spoke to Mr. Curtiss, Town Attorney to come up with a way to change the code so the site plan dollars could reflect the amount needed to restore the site to its original not to go ahead with building Tractor Supply. We will have to wait until Mr. Curtiss returns to let us know how we will set this up, so for now I will table this topic.
Mr. O’Connor made a motion to table this until Mr. Curtiss informs us of how it should be done.

Seconded by Mrs. Nacerino. I know the request form has not been formally approved but again this is a classic example. Mileage has not been incorporated into this overall expense neither has meals. This form will be essential to us to recognize all the actual expenses that we will incur.

LOCAL LAW 150 – AMENDMENT
Mr. Griffin stated Local Law 150 regarding Vehicle and Traffic Violations under the Town Code and I am asking the Board to amend this because it hasn’t been amended in many years and the maximum fee we can ask for tickets and violations is $50.00. The Judges have recommended that they would like to increase the fine to a minimum of $100.00.

Mr. Griffin stated Counselor I spoke with Mr. Curtiss and he has managed to get some sort of judgment against Burdick Farms.
Mr. Lodes, Town Attorney stated he managed to get an order of attachment which secures the $55,000.00 that is in question and it is in litigation.

Mr. Griffin stated for those of you who like to watch the blogs, I have a posting by Paul Johnson, Councilman from Southeast and he states:
Please check out our new website. It was Mr. Yee’s idea to upgrade and the
majority of the Town Board agreed to spend $3,000.00 to do it. I oversaw the process with the help of Bill
Ford and volunteers such as Eric Cyprus and Dennis Castelli. I think you will find it head and shoulders
above any other website in Putnam, but what it is lacking is what the Town of

tool on the Southeast website but it was voted down. Hopefully our residents will someday have this capability too.
Mr. Griffin stated I just wanted to take thirty seconds of your time to give us a pat on the back. We did this as a pilot program for the guy who developed the software and we got it for next to nothing. The County doesn’t have it and only two other Town’s in Putnam County have it and one is still working on it and one is probably not up and running yet either, so good for us!
Mr. Griffin stated the other thing that I was going to put on my agenda but because I hadn’t gotten responses back from all the other Town Supervisor’s is the $120,000.00 grant for the MS4 Program to hire an engineering firm to do a cost analysis study as well as some other work for engineering purposes to meet MS4 compliance. I now have all my recommendation responses back from all the other Towns and the unanimous choice was to hire Malcom Pirnie Engineering. I don’t have a resolution for that tonight but I was told I could do it by motion. Does the Board want to do it now or do you want to wait until we have a resolution.
Mr. Kassay stated I think because of the amount of money let’s do it by resolution. I know we talked about this and he did have the lowest bid.
Mr. Griffin stated they also had the best presentation to the Technical Advisorary Committee.
Mrs. Nacerino stated I have received a memo from the Park Advisory Board:
At a meeting at the Park Advisory Board on
A non-refundable Permit Application Fee of $25.00 should be collected from the applicant for use of the park facilities where the group will be larger than fifteen people. This fee is for a single use one day event. Additionally, any moneys collected shall be allocated only for the Park District.
It is further recommended that this fee schedule be
implemented effective

Mr. Taylor stated I would like to thank the Town Board and I would just like to say that the ever efficient Town Clerk has already developed a new Permit Application, which includes the fee and how it is going to be paid. Antoinette has also added a phrase at the bottom that says: while using the park you and your guests are obligated to recycle the following items; metal cans, plastics 1, 2 and 3. I just want to let the Town Board know that we have ordered but they haven’t been delivered yet, two complete recycling units that will be placed at the park. They are labeled and they also have pictures, so if you can’t read they will be able to see the pictures. We will also be promoting recycling at the park with signs. I want to thank Antoinette for already making this form up and will visit you tomorrow if the Board approves the $25.00 fee and we will revise this to also include glass. Thank you.

Mr. Ray Blanar stated Melissa Brichta never got it in. I followed up on it and was working with Pamela who is with the youth services at the County. There were two things that had to be done paperwork wise. One was urgent that had to get in by the end of the year and I did get that one in. The other one she said she would do with me in January so I would know what I was doing. They are both being taken care of.
Mr. Kassay stated let us know how much we are getting back so we can make a note of it.
Mr. Blanar stated I believe it was two different grants. One for Community Day and one was for youth’s services directly pertaining to lifeguard training. I also received a memo that all youth services will be cut by twenty-five percent.
Mr. Kassay stated did we ever find out if a voucher had to be submitted for the Office of the Aging.
Mr. Griffin stated I think we attached a voucher and it should be in the mail. I would like to say that Janet Ravo has really stepped up to the plate. She has been working late and coming in early and she has done an outstanding job. I also want to thank Sue Brown for helping out. We had her trained in anticipation of a potential problem and no one anticipated the Comptroller, Patricia Brooks going out in December to have her baby.
Mr. Kassay stated I have a memo regarding Commercial Recycling Permits dated December from Frank Farrell, Recycle Administrator:
The revenue for recycle cardboard has plummeted. The Town of
Ms. Edie Keasbey stated how much does it cost to send it where Mr. Gallante used to send it. How much is it for garbage disposal.
Mr. Griffin stated $99.87 per ton.
Mr. Kassay stated we have a contract with AWD, Automated Waste Disposal and they sent us a memo:

In recent weeks we have witnessed the collapse of the market for all cardboard containers. We are happy that to date we have been able to send the recovered materials to market but it has little to no value. The economic down turn, domestically and

continue providing high quality collection and processing services, we are
forced to adjust our rates for processing of recycling materials effective
Mr. Kassay stated we should forward this to the Town Attorney because we have a five year contract in place that doesn’t expire until 2011. I know there was one other instance where they sent us a letter where they wanted to raise something and because we have a contract with them the Town Attorney sent them a letter and they had to abide by our contract. I think it had to do with the gas prices. The last paragraph of their letter states:
We feel these moderate increases will still allow you to maintain continued compliance with the Connecticut State Recycling statues. Please let us know if there is anyway in which we can better serve you.
PUBLIC RECOGNITION
Ms. Luz Shulgin stated this is my first time here at a Patterson Town Board meeting. For 2009 and beyond I would like to become more involved in local government and community organization. I came down tonight to see how the Board process works.
