Salute to the Flag and Roll Call.


Supervisor Griffin called the Patterson Town Board meeting to order at 7:30 p.m. with 10 in attendance.


Mr. Griffin stated please remain standing. This past Saturday a member of our Board of Assessment Review Anna Faley suffered a fatal heart attack. The wake is today and I would just ask for a moment of silence for her. She was a real asset on the Board and will be missed.

TEEN DRIVER SAFETY AWARENESS MONTH IN PUTNAM COUNTY


Mr. Burns introduced Pete Dandreano the Town of Patterson representative for the Putnam County Traffic Safety Board who asked for support for the new Teen Traffic Initiative.


Mr. Griffin wished him well and if there is anything else that the Town can do we would be more than happy to make the investment.


Mr. Burns introduced the following Resolution on the Adoption of Teen Driver Safety Awareness Month in the Town of Patterson:

WHEREAS, statistics and experience demonstrate that the greatest danger to our youth in Putnam County, and throughout our country, are the dangers posed from traffic crashes; and


WHEREAS, Putnam County has advised the Town of Patterson that highway crash statistics indicate that while teen drivers comprise only 7% of the driving population, they are involved in 18% of injury-related automobile crashes, and that the leading cause of accidental deaths to our youthful population through the United States is automobile accidents; and


WHEREAS, reasons for the high percentage of teens in injury-related automobile crashes include driver inexperience, excessive speed, recklessness, inattentive driving and use of alcohol and drugs; and


WHEREAS, in Putnam County we have too often experienced fatal automobile accidents with a teen driver at the wheel, with many of these deaths occurring during the spring and summer months, especially during prom season; and


WHEREAS, many accidents are preventable and crash rates can be lowered through the use of education and awareness programs, and through the use of our school systems, law enforcement programs and programs administered by youth service organizations such as the Boy Scouts, Girl Scouts, Junior RTC programs and Civil Air Patrol, just to name a few; and


WHEREAS, these programs work best when local governments at every level, our school districts, and churches, synagogues and youth service organizations come together to sponsor, promote and recognize the value of these educational programs;


NOW, THEREFORE, be it resolved that the Town Board of the Town of Patterson hereby applauds and supports the Putnam County Legislature and County Executive Mary Ellen Odell in declaring April, 2012 as Teen Driver Safety Awareness Month in Putnam County; and


BE IT FURTHER RESOLVED, that the Town Board of the Town of Patterson hereby joins the Putnam County Legislature in declaring April, 2012 as Teen Driver Safety Awareness Month in the Town of Patterson and encourages all levels of government, law enforcement, our schools, churches and synagogues, our youth service organizations and all citizens of the Town and Putnam County to support programs that promote teen driver safety awareness in Putnam County, thereby protecting our children and grandchildren, our most precious resources.

CHARLES COOK


PUTNAM LAKE PARK DISTRICT – ACTION PLAN


Mr. Cook stated I had sent the Town Board members a short memo listing a number of items that I felt we should put some sort of date to as we move along with the implementation of the District. I would suggest that the transfer of property from the PLCC to the Putnam Lake Park District be done during the month of September. These are all ball park dates to give us some kind of direction. Amend the Municipal Code to include the Putnam Lake Park Advisory Board for May, solicit volunteers to serve on the Advisory Board we are doing that now. Develop operating criteria for the Putnam Lake Park Advisory Board in May. Insure Putnam Lake Park District is in the 2013 budget for August and September. Interview candidates for the Putnam Lake Advisory Board in September. We do have a number of folks who have expressed interest already. We are still looking for more people to let us know they are interested so we could do this in May. Interview the candidates in June. Create the Advisory Board in July. This is all flexible. Then give those who are choosing a work plan or ask them to develop a work plan and review it with us in July or August.


Mrs. Nacerino stated I think Mike needs to appoint liaisons to this Board so we have someone who could attend the meetings.


Ms. Dede Lifgren stated I appreciate you doing a schedule that is great. Do we have to wait another month…..


Mr. Griffin stated right now we have to work on the code changes. The Board probably won’t be established until the end of April in the code.


Ms. Lifgren stated we are looking to interview in May.


Mr. Griffin stated we could start in April but if we are going to cut it off May 1st then we would start the interview process in May.


Ms. Lifgren stated the sooner we have the Advisory Board the more input they could have.


PUTNAM LAKE PARK DISTRICT LAWS – DISCUSSION


Mr. Cook stated we have received copies of proposed laws for the Putnam Lake Park District and the Veterans Park on Maple Avenue. I would suggest that we have a work session working on this because there is a lot of material here.


Ms. Cari Weizenecker stated do you want our input as a Board because we have changes for ours.


Mr. Griffin stated absolutely. Yes.


Ms. Weizenecker stated is our code going to be the same as their park.


Mr. Griffin stated no two separate codes.


Town Board members set a Work Session on Tuesday, April 10, 2012 at 4:00 p.m.


Mr. Griffin asked Antoinette Kopeck, Town Clerk to advertise the Work Session.


TOWN’S LIABILITY INSURANCE – DISCUSSION


Mr. Cook stated we have renewed the policy for the next year. I think we should consider going out for bids for 2013-2014. I just ask to keep that in mind for the next time.

PUTNAM LAKE SENIORS REQUEST – 40TH ANNIVERSARY CELEBRATION


Mr. McCarthy made a motion to approve a 40th Anniversary Celebration for the Putnam Lake Seniors not to exceed $250.00.

JUSTICE COURT REQUEST – VIDEO SURVEILLANCE


Mr. McCarthy introduced the following Resolution for Purchase of Equipment for Upgrade of Courthouse Video Surveillance System:

WHEREAS, the Town Board of the Town of Patterson has received a “Non-Bid/RFP Procurement Request Form” from the Patterson Building Maintenance & Operations Department dated March 15, 2012 requesting and recommending the purchase from Structured Home Solutions, LLC of two (2) interior dome cameras, one (1) 17" video monitor and one (1) computer mouse and the installation thereof for use in the Town Court video surveillance system; and


WHEREAS, the proposed purchase has been recommended following the receipt of three (3) written proposals in conformity with the Town’s Procurement Policy,


NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Patterson

hereby accepts the recommendation of the Building Maintenance & Operations Department as set forth in said March 15, 2011 Request Form, a copy of which is to be annexed to this Resolution, and the purchase of the equipment and services recommended therein is hereby approved; and


BE IT FURTHER RESOLVED, that the Town Board of the Town of Patterson hereby

authorizes the Supervisor to execute any and all documents necessary to give effect to this resolution.

LANDFILL POST CLOSURE MONITORING - RESOLUTION


Mr. Griffin introduced the following Resolution for Acceptance of Proposal of

Sterling Environmental Engineering, P.C. to Perform the 2012 Environmental Monitoring Program for the Town Landfill:

WHEREAS, by letter dated March 21, 2012, STERLING ENVIRONMENTAL ENGINEERING, P.C. has submitted an estimate of the cost to perform the annual Environmental Monitoring Program ("EMP") in accordance with the Post-Closure Monitoring and Maintenance Manual for the Town of Patterson Landfill, together with the "Standard Terms and Conditions" applicable to the EMP (collectively, the "Proposal"); and


WHEREAS, STERLING ENVIRONMENTAL ENGINEERING, P.C. has estimated that the cost for the EMP at the Landfill for the year 2012 will be $5,785; and


WHEREAS, the Town Board of the Town of Patterson wishes to accept the Proposal as submitted by STERLING ENVIRONMENTAL ENGINEERING, P.C., a full and complete copy of which is annexed hereto,


NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Patterson hereby accepts the Proposal of STERLING ENVIRONMENTAL ENGINEERING, P.C. to perform the annual monitoring for the year 2011 in accordance with the Post-Closure Monitoring and Maintenance Manual for the Town of Patterson Landfill for the estimated cost of $5,785; and


BE IT FURTHER RESOLVED, that the Town Board of the Town of Patterson hereby authorizes the Supervisor to execute the Proposal and any and all other documents as may be necessary to give full effect to this resolution.

LOSAP – DISCUSSION/RESOLUTION


Mr. Griffin stated under the Equipment Opportunity Employment, EEOC you can’t exclude people over the age of 65 or any age basically from obtaining points and staying in the program. What our program had called for and what was agreed to by the Fire Department was that 65 was the cut off. You could no longer continue to accrue points and you had to take your retirement. There was a law suit filed out on Long Island. The people who filed the suit prevailed, so we are no longer allowed to limit people at the age of 65 or force them out. Along with that comes some payments and also back pay for some of the individuals who had accrued points but weren’t credited the points. Patricia Brooks, Comptroller and I have been working with LOSAP and Trish did a memo basically calling for five installments of approximately $39,000.00 and an additional one payment of approximately $38,000.00. If the Board is agreeable to this, there is enough money. We budgeted the money for it this year to get this done. Please read this information and I will bring this up for a vote at the next meeting.


Mr. Cook stated the money we have in the budget this year is for one payment.


Mr. Griffin stated yes, one payment of $39,000.00. We do not have the other for the retro pay that will be part of next year. That is Trisha’s recommendation and I concur with it.


PUTNAM COUNTY BID ELECTRIC & GAS – DISCUSSION


Mr. Griffin read a letter from Putnam County exploring the possibility of competitively bidding electricity and/or natural gas supply from interested Energy Service Companies (ESCOs). The County is currently under contract with Integrys Energy on a fixed rate. My question to the Board is would you like us to supply the information and see if they can get us a better rate. I think there is approximately 40 different companies that service New York State in this area that provide electricity. I don’t know how many natural gas companies there are. After deregulation similar to what happened to the phones, anyone and their brother can sell electricity. NYSEG, CON ED and Central Hudson are no longer allowed to monopolize generation, transmission and delivery.


Mrs. Nacerino stated there has been so much discussion about shared services over the last couple of years and I think this is a great attempt to do just that. I would be favorable towards giving the information to Putnam County to see if we can come up with a good rate.


Mr. Cook stated we have nothing to lose. Let’s do it.

TOWN HALL COMPUTERS – REPLACEMENT SCHEDULE


Mr. Griffin made a motion to approve the replacement of Town Hall computers not to exceed $2,400.00.

Mr. Griffin made a motion to add a memo from the Assessor regarding assessment change notices.

Mr. Griffin stated we received a memo on March 26, 2012 from Christopher Boryk, Assessor regarding Assessment Change Notices. This change would equate to an annual savings of $2,220.00.


Mr. Griffin made a motion to approve the Assessor’s request that they no longer mail out the notices of Change of Assessment and publish the assessments online beginning May 1, 2012.

PORTABLE TOILET PROPOSAL - AWARD OF BID


Mrs. Nacerino introduced the following Resolution for Portable Toilet Rental:

WHEREAS, the Town Board of the Town of Patterson has received a “Non-Bid/RFP

Procurement Request Form” from the Patterson Building Maintenance & Operations

Department dated March 19, 2012 requesting and recommending the renting from A Royal

Flush, Inc of three (3) portable toilets, with one (1) to be kept and maintained at Club Court

Park and two (2) to be kept and maintained at Cornwall Ball Field; and


WHEREAS, the proposed purchase has been recommended following the receipt of two (2) written proposals and one (1) verbal quote in conformity with the Town’s Procurement Policy,


NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Patterson

hereby accepts the recommendation of the Building Maintenance & Operations Department as set forth in said March 19, 2011 Request Form, a copy of which is to be annexed to this Resolution, and the rental of the portable toilets as recommended therein is hereby approved; and


BE IT FURTHER RESOLVED, that the Town Board of the Town of Patterson hereby

authorizes the Supervisor to execute any and all documents necessary to give effect to this resolution.

PAB CARETAKER – JOB DESCRIPTION


Mrs. Nacerino stated we spoke to the Park Advisory Board in reference to updating the job description of the caretaker. The PAB collaborated and has submitted a job description for Brian Burdick who is our caretaker. I would ask that the Board members review this and give any input that you have to revising this so that we can firm it up and have a job description in place and on file. I would like to bring to the Boards attention that the hours have been extended at the park which is now from May 1st to October 1st and the original time frame was from Memorial Day through Labor Day. Brian was very receptive to this but he has added two more months to his position and scope of duties. Charlie Cook and I discussed that we did not have any job description in place for the other two caretakers at Ted Bauman Park and the environmental park. I sent a memo to Rick Saracelli and Janeada Grady to submit a list of their duties, their time and the days they work so we can develop a true scope of their duties.


Ms. Cari Weizenecker stated not only has the job description gone from Memorial Day to Labor Day people are actually using the park three or four days a week. This is a part-time caretaker’s position. Brian is very flexible and when he was originally hired he was to be there from Memorial Day until Labor Day but now the usage is extended.


RECREATION REQUEST PROPOSAL


Mrs. Nacerino read memo’s from Matt Chibbaro, Recreation Director.


Mrs. Nacerino made a motion to approve adding a Theater camp and LEGO Engineering class.

Mrs. Nacerino made a motion to accept a High School Summer Basketball League and an aftercare program for our kindergarten enrichment class.

DEPARTMENT UPDATES


PAB


Mrs. Nacerino stated on March 17, 2012 the Town Board, members of the PAB and Rich Williams did a Capital Plan walk through of the park. We inspected all the improvements that the PAB had cited for us including the bathrooms, the fences and tree work. This was a very informative site walk. The consensus of this Board was that we would like to move forward with the Capital Plan. One of the main priorities is the sidewalk maintenance and Rich was good enough to diligently work on it a few days later and come up with different specifications and variations. We would like the PAB to review this and advise us on which direction they would like to go and then put it out to bid. I also attended a March 21, 2012 meeting. Russ and the Highway Department will install a new flag pole that was given to the park from the library. The Highway Department agreed to help out with various other things at the park. Thank you Russ and the Highway Department.


Mrs. Nacerino continued with the updates and improvements to the park.


RECREATION DEPARTMENT


Mrs. Nacerino and Mr. Cook attended the Easter Egg Hunt on Saturday. This was a joint effort with the Patterson Fire Department. It was a success.


PLANNING & ZONING BOARD


Mrs. Nacerino stated I spoke to Shawn Rogan and he had highlighted some of the things that the Planning Board was reviewing. He indicated that the fact finding statement and the environmental review process has been completed for the Watch Tower expansion. This is a huge thing for the Town. The Planning Board is also working on the site plan review for a nursery. M&S is coming to the industrial park. They will all support our commercial tax base.


Mrs. Nacerino stated the Zoning Board usually increases their case load at this time as people begin to do their home improvements. I encourage all of you to please make sure you call the Building Department prior to starting any project to make sure you are in compliance with our Town Code. The Zoning Board will be holding a Public Hearing on April 10, 2012 at 7:00 p.m. at the Recreation Center in reference to the proposed cell tower in Putnam Lake.


OTHER BUSINESS


Ms. Cari Weizenecker stated I would like to review. We went through the walk through and we need to get everything in order of what we want and take off the things we discussed and then certain things you will get quotes on and certain things we will get quotes on.


Mr. Griffin stated yes.


Mrs. Nacerino made a motion to add one other item to her agenda.

Mrs. Nacerino stated we were very saddened to hear of the passing of Anna Faley who was a long standing member of the Board of Assessment Review. Unfortunately it has come to my attention that time is of the essence with the mandatory training to be held on April 26, 2012.


Mrs. Nacerino made a motion to have Antoinette Kopeck, Town Clerk advertise for this vacancy for the Board of Assessment Review.

Mr. Griffin stated there is a 250 year old oak tree by the Baptist Church on Route 311 that was seriously damaged in the snow storm last October. The D.O.T. will be taking that tree down tomorrow morning. Unfortunately another landmark tree in Patterson is going away.


Mrs. Nacerino read her Environmental Tip.

PUBLIC RECOGNITION

Ms. Dede Lifgren stated have you contacted the PLCC. What is happening with that.


Mr. Griffin stated yes, we have a meeting scheduled on April 4, 2012 with the PLCC to start initial discussions. They have provided the Town Attorney’s office with the name of their new attorney and I believe there have been some communications back and forth as to what the Town would like to discuss at the meeting. They have agreed to be at the meeting. As soon as we have some definitive directions we will let everyone know what comes out of that.


Ms. Lifgren stated I was wondering if you would consider anyone else from Putnam Lake coming to the meeting to observe.


Mr. Griffin stated no, not at this time.
